IMPORTANT NOTICE

This document is an English translation of the original Czech Terms and Conditions ("Obchodní podmínky"). This translation is provided for informational purposes only.

The HopNaWorkshop platform is intended for use exclusively in the Czech Republic. The service is designed for Czech users, uses Czech banking standards (variable symbols, QR payments), and operates under Czech law.

In case of any discrepancy between this English translation and the Czech original, the Czech version shall prevail and be legally binding. The Czech version is available at http://hopnaworkshop.cz/terms.


1. Introductory Provisions

1.1 Operator Identification

These Terms and Conditions (hereinafter "Terms") govern the rights and obligations related to the use of the HopNaWorkshop internet platform available at http://hopnaworkshop.cz (hereinafter "Platform").

1.2 Definitions

For the purposes of these Terms:

  • Platform means the HopNaWorkshop internet application enabling the creation and management of workshops and registrations;
  • Host means a natural or legal person who creates and offers workshops through the Platform;
  • Attendee means a natural person who registers for a workshop through the Platform;
  • User means a collective term for both Hosts and Attendees;
  • Workshop means an educational, creative, or other event organized by a Host and offered through the Platform.

1.3 Acceptance of Terms

By registering on the Platform or submitting a workshop registration, the User confirms that they have read, understood, and agree to these Terms in full. Use of the Platform without agreeing to these Terms is not permitted.


2. Nature of Service and Operator's Position

2.1 Platform as Intermediary

The Platform is a technical tool that enables Hosts to create and manage workshop offerings and Attendees to register for these workshops.

The Operator acts exclusively as an intermediary within the meaning of Act No. 480/2004 Coll., on Certain Information Society Services. The Operator:

  • is not a party to any contract concluded between the Host and the Attendee;
  • does not guarantee the occurrence, quality, content, or the Host's expertise regarding the workshop;
  • does not process payments – it only generates documents for direct bank transfers between the Attendee and the Host;
  • is not liable for the actions or omissions of Hosts or Attendees.

2.2 Relationship Between Host and Attendee

By registering for a workshop, a contractual relationship is established directly between the Host and the Attendee. The terms of this relationship, particularly cancellation terms and participation conditions, are determined by the Host. The Operator does not enter into this relationship and bears no responsibility for it.

2.3 Service Limitations

The Platform is currently in test mode. The Operator reserves the right to:

  • limit or suspend Platform operation without prior notice;
  • change functions and scope of services;
  • terminate test operation and introduce paid services (with prior notice).

3. Registration and User Accounts

3.1 Host Registration

To create a Host account, the applicant must:

a) be at least 18 years old; b) provide a valid email address and verify it; c) agree to these Terms and the Privacy Policy; d) provide accurate information about themselves or their business.

A Host offering workshops as part of business activities is required to provide their Business ID (IČO) and comply with applicable legal regulations (Trade Licensing Act, tax regulations, etc.).

3.2 Attendee Registration for Workshop

To register for a workshop, an Attendee must:

a) be at least 18 years old, or have parental/guardian consent; b) provide accurate contact information (name, email, optionally phone); c) complete mandatory fields specified by the Host in the registration form; d) agree to these Terms and the Privacy Policy; e) agree to the cancellation terms set by the Host.

In the case of Attendees under 18 years of age, the legal guardian is responsible for compliance with these Terms and participation in the workshop.

3.3 Responsibility for Information

The User is responsible for the accuracy, completeness, and currency of information provided during registration. The Operator does not verify the accuracy of this information and is not liable for the consequences of providing false information.

3.4 Account Security

The User is obligated to protect their account access credentials from misuse. The account holder is responsible for all activities performed through their user account.


4. Rules for Hosts

4.1 Host Obligations

The Host agrees to:

a) provide accurate and complete information about workshops, including description, date, venue, and price; b) set clear cancellation terms and make them available to Attendees before registration; c) ensure the workshop takes place as described; d) communicate with Attendees in case of changes or cancellation; e) comply with applicable laws of the Czech Republic, particularly consumer protection, trade licensing, and tax regulations; f) properly process all received payments and issue Attendees with a tax document (invoice) in accordance with Act No. 235/2004 Coll., on Value Added Tax, or another appropriate document according to applicable accounting and tax regulations – the Platform does not issue these documents; g) ensure the safety of Attendees during the workshop; h) process Attendees' personal data in accordance with GDPR and use them exclusively for workshop purposes.

4.2 Payment Details

The Host is required to provide valid bank account details for receiving payments from Attendees. The Host is solely responsible for the accuracy of bank details. The Operator is not liable for payments sent to an incorrect account due to erroneous information provided by the Host.

4.3 Prohibited Content

The Host may not offer through the Platform workshops that:

a) promote or incite illegal activity; b) contain discriminatory, hateful, or otherwise objectionable content; c) infringe the intellectual property rights of third parties; d) are fraudulent or misleading; e) involve dangerous activities without appropriate safety measures; f) otherwise violate legal regulations or good morals.

4.4 Consequences of Violation

In case of violation of these Terms, the Operator is entitled to:

a) request the Host to remedy the violation; b) hide or remove objectionable content; c) temporarily suspend the Host's account; d) permanently terminate the Host's account.

The Host will be informed of measures taken. In serious cases (particularly for clearly illegal content), the Operator may act without prior notice.


5. Payments

5.1 Payment Method

Payments for workshops are made via direct bank transfer from the Attendee to the Host's bank account. The Platform generates a QR code with payment details in SPD 1.0 format, which facilitates payment through banking applications.

5.2 Variable Symbol

Each registration is assigned a unique variable symbol (variabilní symbol) that serves to identify the payment. The Attendee is required to include this variable symbol when making the payment.

5.3 Operator Does Not Process Payments

The Operator:

  • does not receive, hold, or transfer Attendees' funds;
  • does not have access to the bank accounts of Hosts or Attendees;
  • is not liable for failed, incorrect, or delayed payments;
  • is not liable for refunds – these matters are resolved directly between the Host and Attendee.

5.4 Service Fees

Use of the Platform is currently free of charge. The Operator reserves the right to introduce service fees in the future, of which Users will be notified in advance.


6. Intellectual Property Rights

6.1 Platform Ownership

The Platform, its source code, graphic design, logo, and all content created by the Operator are protected by copyright and other intellectual property rights. The User is not authorized to copy, modify, distribute, or otherwise use these elements without prior written consent of the Operator.

6.2 Host Content

The Host retains all rights to content they upload to the Platform (texts, images, workshop descriptions). By uploading content to the Platform, the Host grants the Operator a non-exclusive, royalty-free license to use this content to the extent necessary for Platform operation, particularly for its display and distribution.

6.3 Prohibition of Unauthorized Use

Without the Operator's consent, the User may not:

a) copy, download, or automatically collect (scrape) Platform content; b) decompile, analyze, or otherwise examine the Platform's source code; c) use the Platform to create competing services.


7. Limitation of Liability

7.1 Operator's Liability

The Operator is only liable for damage caused by intentional breach of its obligations or gross negligence. The Operator's liability is limited to direct damage; the Operator is not liable for indirect damage, lost profits, or consequential damages.

7.2 Exclusion of Liability

The Operator is not liable in particular for:

a) actions or omissions of Hosts or Attendees; b) quality, content, course, or non-occurrence of workshops; c) disputes between Hosts and Attendees, including refund disputes; d) damage caused by Users providing false information; e) damage caused by misuse of User's access credentials; f) technical outages or Platform unavailability; g) data loss beyond what the Operator could influence.

7.3 Indemnification

The Host agrees to indemnify the Operator against all third-party claims arising in connection with:

a) content published by the Host on the Platform; b) Host's violation of these Terms; c) Host's violation of third-party rights; d) realization or non-realization of the workshop.


8. Reporting Objectionable Content

8.1 Reporting Option

Every User has the right to report content they consider objectionable or in violation of these Terms. Reports can be submitted via:

8.2 Report Content

A report should include:

a) identification of the objectionable content (link to the workshop); b) description of the reason for the report; c) reporter's contact details (optional but recommended).

8.3 Handling Procedure

The Operator will assess the report without undue delay. The reporter may be informed of the outcome if they provided contact details. In case of clearly illegal content, the Operator will make the content inaccessible immediately.


9. Termination of Service Use

9.1 Account Deletion by User

The User may request deletion of their account at any time by sending a request to info@hopnaworkshop.cz. Account deletion does not affect already completed workshop registrations or obligations arising from them.

9.2 Account Deletion by Operator

The Operator is entitled to delete or suspend the account of a User who:

a) violates these Terms; b) provided false information; c) misuses the Platform; d) acts contrary to legal regulations or good morals.

9.3 Consequences of Deletion

After account deletion:

a) the User loses access to their account and its content; b) the Operator may archive data for the period necessary to fulfill legal obligations; c) rights and obligations arising before deletion remain preserved.


10. Personal Data Protection

Personal data processing is governed by the Privacy Policy, which is available at http://hopnaworkshop.cz/privacy and forms an integral part of these Terms.


11. Final Provisions

11.1 Governing Law

These Terms are governed by the laws of the Czech Republic, particularly Act No. 89/2012 Coll., the Civil Code, and Act No. 480/2004 Coll., on Certain Information Society Services.

11.2 Dispute Resolution

Any disputes will be resolved preferably through amicable means. If no agreement is reached, the courts of the Czech Republic have jurisdiction to resolve disputes.

For consumers: In case of a dispute, you have the right to contact the Czech Trade Inspection Authority (ČOI) as an out-of-court consumer dispute resolution body. More information at www.coi.cz. For online dispute resolution, you can use the ODR platform: https://ec.europa.eu/consumers/odr.

11.3 Severability

If any provision of these Terms is invalid or unenforceable, this does not affect the validity of the remaining provisions. The invalid provision will be replaced by a provision that most closely corresponds to the original intent in meaning and purpose.

11.4 Amendments to Terms

The Operator is entitled to unilaterally amend these Terms. Users will be notified of material changes by email at least 30 days before the changes take effect. If the User disagrees with the changes, they have the right to terminate use of the service and delete their account. By continuing to use the Platform after the changes take effect, the User expresses agreement with the new version of the Terms.

11.5 Entire Agreement

These Terms together with the Privacy Policy constitute the entire agreement between the User and the Operator regarding use of the Platform and supersede all prior agreements.
